DRIVING UNDER THE INFLUENCE
Driving under the influence of drugs or alcohol are very serious charges which the State Legislator continues to impose tougher sentencing guidelines.
California Vehicle Code Section 23152(a)
is defined as:
any person driving under the influence of any alcoholic beverage and/or drug
Under subsection (b):
any person driving who has 0.08 percent or more of alcohol in his or her system to drive a vehicle.
Penalties imposed include:
License Suspension
Probation: 1-5 Years
Alcohol Classes
Madd - Drunk Driver's Program (depending on jurisdiction)
Fines: $390.00 to $1,000.00 +
Potential custody: 0 to 6 Months
For a 4th DUI - possibly state prison
Ignition Interlock Devices
An Ignition Interlock Device (IID) is a mechanical device, about the size of a cell phone that attaches to your vehicle’s ignition. This device may be required in some cases.
If the driver was driving under the influence of an illegal drugs, he or she could also be charged with HS Code 11550(a) Under the Influence of Drugs another serious charge which could entail custody of possibly 3 months to 1 year in the county jail.
DUI With An Accident
If there was an accident involving injury to one other than the driver then the case can be charged as a felony, depending on the injuries.
In the following instances the case could be charged with “enhancements” which add to the potential penalties:
The BAC was over .20%.
Refuse to submit to a chemical test
A child under 14 was in the car
Traveling 20 miles over the speed limit
Under 21
Property damage or injury.
